{"id":22665,"date":"2026-01-14T13:43:22","date_gmt":"2026-01-14T12:43:22","guid":{"rendered":"https:\/\/www.stepv.upv.es\/?p=22665"},"modified":"2026-01-14T14:25:24","modified_gmt":"2026-01-14T13:25:24","slug":"guardies-de-dissabte-que-esta-passant-i-que-reclamem","status":"publish","type":"post","link":"https:\/\/www.stepv.upv.es\/va\/guardies-de-dissabte-que-esta-passant-i-que-reclamem\/","title":{"rendered":"Gu\u00e0rdies de dissabte: qu\u00e8 est\u00e0 passant i qu\u00e8 reclamem"},"content":{"rendered":"<p><\/p>\n<p data-start=\"277\" data-end=\"627\">En les darreres setmanes, el personal auxiliar de serveis de la UPV ha rebut la comunicaci\u00f3 que <strong data-start=\"373\" data-end=\"464\">les persones amb jornada redu\u00efda ja no poden realitzar gu\u00e0rdies volunt\u00e0ries en dissabte<\/strong>, una possibilitat que fins ara s\u2019havia vingut exercint amb normalitat i que suposava un complement retributiu important per a moltes treballadores i treballadors.<\/p>\n<p data-start=\"629\" data-end=\"806\">Aquesta decisi\u00f3 ha generat <strong data-start=\"656\" data-end=\"696\">incertesa, malestar i un clar greuge<\/strong>, especialment entre el personal que ha sol\u00b7licitat la reducci\u00f3 de jornada per motius de conciliaci\u00f3 familiar.<\/p>\n<h2 data-start=\"808\" data-end=\"835\">1. Quin \u00e9s el problema?<\/h2>\n<p data-start=\"837\" data-end=\"990\">El problema \u00e9s clar:<br data-start=\"857\" data-end=\"860\" \/><strong data-start=\"860\" data-end=\"960\">un col\u00b7lectiu concret \u2014el personal amb jornada redu\u00efda\u2014 queda excl\u00f2s de les gu\u00e0rdies de dissabte<\/strong>, tot i que aquestes gu\u00e0rdies:<\/p>\n<ul data-start=\"991\" data-end=\"1112\">\n<li data-start=\"991\" data-end=\"1009\">\n<p data-start=\"993\" data-end=\"1009\">s\u00f3n volunt\u00e0ries,<\/p>\n<\/li>\n<li data-start=\"1010\" data-end=\"1058\">\n<p data-start=\"1012\" data-end=\"1058\">cobreixen necessitats estructurals del servei,<\/p>\n<\/li>\n<li data-start=\"1059\" data-end=\"1112\">\n<p data-start=\"1061\" data-end=\"1112\">i s\u2019han realitzat de manera continuada durant anys.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1114\" data-end=\"1348\">Aquesta exclusi\u00f3 implica una <strong data-start=\"1143\" data-end=\"1171\">p\u00e8rdua econ\u00f2mica directa<\/strong> i suposa, en la pr\u00e0ctica, <strong data-start=\"1198\" data-end=\"1269\">penalitzar l\u2019exercici d\u2019un dret legal com \u00e9s la reducci\u00f3 de jornada<\/strong>, dret que majorit\u00e0riament s\u2019exerceix per cura de fills o familiars dependents.<\/p>\n<h2 data-start=\"1355\" data-end=\"1424\">2. Quan \u00e9s cert que no es poden fer: si s\u00f3n hores extraordin\u00e0ries<\/h2>\n<p data-start=\"1426\" data-end=\"1565\">Cal dir-ho clar:<br data-start=\"1442\" data-end=\"1445\" \/><strong data-start=\"1445\" data-end=\"1512\">si les gu\u00e0rdies de dissabte es consideren hores extraordin\u00e0ries<\/strong>, l\u2019argument utilitzat per la Ger\u00e8ncia t\u00e9 base legal.<\/p>\n<p data-start=\"1567\" data-end=\"1594\">La normativa estableix que:<\/p>\n<ul data-start=\"1595\" data-end=\"1825\">\n<li data-start=\"1595\" data-end=\"1647\">\n<p data-start=\"1597\" data-end=\"1647\">les hores extraordin\u00e0ries han de ser excepcionals,<\/p>\n<\/li>\n<li data-start=\"1648\" data-end=\"1711\">\n<p data-start=\"1650\" data-end=\"1711\">no poden formar part de l\u2019organitzaci\u00f3 ordin\u00e0ria del treball,<\/p>\n<\/li>\n<li data-start=\"1712\" data-end=\"1825\">\n<p data-start=\"1714\" data-end=\"1825\">i <strong data-start=\"1716\" data-end=\"1762\">no s\u00f3n compatibles amb una jornada redu\u00efda<\/strong>, perqu\u00e8 suposen una ampliaci\u00f3 volunt\u00e0ria del temps de treball.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1827\" data-end=\"1885\">En aquest escenari concret, <strong data-start=\"1855\" data-end=\"1884\">la prohibici\u00f3 seria legal<\/strong>.<\/p>\n<h2 data-start=\"1892\" data-end=\"1965\">3. Per\u00f2 hi ha una altra interpretaci\u00f3 possible (i perfectament legal)<\/h2>\n<p data-start=\"1967\" data-end=\"2067\">Ara b\u00e9, aquesta <strong data-start=\"1983\" data-end=\"2023\">no \u00e9s l\u2019\u00fanica interpretaci\u00f3 possible<\/strong>, ni tampoc l\u2019\u00fanica que permet la normativa.<\/p>\n<p data-start=\"2069\" data-end=\"2221\">Existeix en altres \u00e0mbits de la funci\u00f3 p\u00fablica \u2014especialment en sanitat\u2014 una figura diferent:<br data-start=\"2162\" data-end=\"2165\" \/>\ud83d\udc49 <strong data-start=\"2168\" data-end=\"2215\">la jornada complement\u00e0ria o servei especial<\/strong>, que:<\/p>\n<ul data-start=\"2222\" data-end=\"2372\">\n<li data-start=\"2222\" data-end=\"2260\">\n<p data-start=\"2224\" data-end=\"2260\">no es considera hora extraordin\u00e0ria,<\/p>\n<\/li>\n<li data-start=\"2261\" data-end=\"2294\">\n<p data-start=\"2263\" data-end=\"2294\">no amplia la jornada ordin\u00e0ria,<\/p>\n<\/li>\n<li data-start=\"2295\" data-end=\"2322\">\n<p data-start=\"2297\" data-end=\"2322\">t\u00e9 una retribuci\u00f3 pr\u00f2pia,<\/p>\n<\/li>\n<li data-start=\"2323\" data-end=\"2372\">\n<p data-start=\"2325\" data-end=\"2372\">i respon a necessitats estructurals del servei.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2374\" data-end=\"2498\">Les gu\u00e0rdies de dissabte dels auxiliars de serveis <strong data-start=\"2425\" data-end=\"2464\">s\u2019assemblen molt m\u00e9s a aquest model<\/strong> que no a una hora extra cl\u00e0ssica:<\/p>\n<ul data-start=\"2499\" data-end=\"2629\">\n<li data-start=\"2499\" data-end=\"2517\">\n<p data-start=\"2501\" data-end=\"2517\">s\u00f3n previsibles,<\/p>\n<\/li>\n<li data-start=\"2518\" data-end=\"2536\">\n<p data-start=\"2520\" data-end=\"2536\">s\u00f3n peri\u00f2diques,<\/p>\n<\/li>\n<li data-start=\"2537\" data-end=\"2568\">\n<p data-start=\"2539\" data-end=\"2568\">es planifiquen amb antelaci\u00f3,<\/p>\n<\/li>\n<li data-start=\"2569\" data-end=\"2629\">\n<p data-start=\"2571\" data-end=\"2629\">i cobreixen serveis que la universitat necessita garantir.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"2636\" data-end=\"2688\">4. No hi ha cap impediment legal per negociar-ho<\/h2>\n<p data-start=\"2690\" data-end=\"2865\">\u00c9s important deixar-ho clar:<br data-start=\"2718\" data-end=\"2721\" \/><strong data-start=\"2721\" data-end=\"2825\">no hi ha res en la normativa que impedisca crear i regular una figura pr\u00f2pia de gu\u00e0rdies de dissabte<\/strong>, diferent de les hores extraordin\u00e0ries.<\/p>\n<p data-start=\"2867\" data-end=\"2883\">Aix\u00f2 requeriria:<\/p>\n<ul data-start=\"2884\" data-end=\"2989\">\n<li data-start=\"2884\" data-end=\"2902\">\n<p data-start=\"2886\" data-end=\"2902\">regulaci\u00f3 clara,<\/p>\n<\/li>\n<li data-start=\"2903\" data-end=\"2925\">\n<p data-start=\"2905\" data-end=\"2925\">negociaci\u00f3 sindical,<\/p>\n<\/li>\n<li data-start=\"2926\" data-end=\"2989\">\n<p data-start=\"2928\" data-end=\"2989\">i una definici\u00f3 adequada del r\u00e8gim retributiu i organitzatiu.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2991\" data-end=\"3032\">Per\u00f2 <strong data-start=\"2996\" data-end=\"3022\">\u00e9s perfectament viable<\/strong> i, a m\u00e9s:<\/p>\n<ul data-start=\"3033\" data-end=\"3170\">\n<li data-start=\"3033\" data-end=\"3070\">\n<p data-start=\"3035\" data-end=\"3070\">evitaria exclusions injustificades,<\/p>\n<\/li>\n<li data-start=\"3071\" data-end=\"3099\">\n<p data-start=\"3073\" data-end=\"3099\">garantiria la conciliaci\u00f3,<\/p>\n<\/li>\n<li data-start=\"3100\" data-end=\"3170\">\n<p data-start=\"3102\" data-end=\"3170\">i donaria seguretat jur\u00eddica tant al personal com a l\u2019Administraci\u00f3.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"3177\" data-end=\"3223\">5. El que ja s\u2019ha treballat, s\u2019ha de pagar<\/h2>\n<p data-start=\"3225\" data-end=\"3276\">Finalment, volem deixar una q\u00fcesti\u00f3 <strong data-start=\"3261\" data-end=\"3275\">molt clara<\/strong>:<\/p>\n<p data-start=\"3278\" data-end=\"3328\">\ud83d\udc49 <strong data-start=\"3281\" data-end=\"3328\">Tot el treball realitzat s\u2019ha de retribuir.<\/strong><\/p>\n<p data-start=\"3330\" data-end=\"3360\">Les gu\u00e0rdies que ja s\u2019han fet:<\/p>\n<ul data-start=\"3361\" data-end=\"3506\">\n<li data-start=\"3361\" data-end=\"3386\">\n<p data-start=\"3363\" data-end=\"3386\">han estat autoritzades,<\/p>\n<\/li>\n<li data-start=\"3387\" data-end=\"3419\">\n<p data-start=\"3389\" data-end=\"3419\">han prestat un servei efectiu,<\/p>\n<\/li>\n<li data-start=\"3420\" data-end=\"3506\">\n<p data-start=\"3422\" data-end=\"3506\">i <strong data-start=\"3424\" data-end=\"3471\">no poden quedar sense compensaci\u00f3 econ\u00f2mica<\/strong> per un canvi posterior de criteri.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3508\" data-end=\"3630\">Des del sindicat <strong data-start=\"3525\" data-end=\"3564\">hem preparat un<a href=\"https:\/\/www.stepv.upv.es\/wp-content\/uploads\/2026\/01\/MODELO-AUXILIARES.docx\"> model de reclamaci\u00f3<\/a><\/strong> perqu\u00e8 cap treballadora ni treballador veja vulnerat aquest dret.<\/p>\n<p><strong data-start=\"3641\" data-end=\"3654\"><br \/>\nConclusi\u00f3<\/strong><\/p>\n<ul data-start=\"3656\" data-end=\"3910\">\n<li data-start=\"3656\" data-end=\"3718\">\n<p data-start=\"3658\" data-end=\"3718\">El problema no s\u00f3n les gu\u00e0rdies, sin\u00f3 <strong data-start=\"3696\" data-end=\"3717\">com es defineixen<\/strong>.<\/p>\n<\/li>\n<li data-start=\"3719\" data-end=\"3797\">\n<p data-start=\"3721\" data-end=\"3797\">Penalitzar la reducci\u00f3 de jornada <strong data-start=\"3755\" data-end=\"3796\">no \u00e9s una soluci\u00f3 justa ni necess\u00e0ria<\/strong>.<\/p>\n<\/li>\n<li data-start=\"3798\" data-end=\"3857\">\n<p data-start=\"3800\" data-end=\"3857\">Hi ha alternatives legals, negociables i m\u00e9s equitatives.<\/p>\n<\/li>\n<li data-start=\"3858\" data-end=\"3910\">\n<p data-start=\"3860\" data-end=\"3910\">I el treball fet <strong data-start=\"3877\" data-end=\"3909\">s\u2019ha de pagar, sense excuses<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"3912\" data-end=\"3967\"><strong data-start=\"3912\" data-end=\"3967\"><br \/>\nGu\u00e0rdies s\u00ed.
